#17 - still does not equal grand larceny
June 6, 2018 7:37 am

Post the whole statute. You think he was wearing a $100 kippah?

what grand larceny means legally in NY
June 5, 2018 8:52 am

A person is guilty of grand larceny in the fourth degree when he steals property and when: 1. The value of the property exceeds one thousand dollars;  or 2. The property consists of a public record, writing or instrument kept, filed or deposited according to law with or in the keeping of any public office or public servant;  or 3. The property consists of secret scientific material;  or 4. The property consists of a credit card or debit card;  or 5. The property, regardless of its nature and value, is taken from the person of another;  or 6. The property, regardless of its nature and value,… Read more »

I don’t think that these 2 12 year old new what they were doing

they thought it was funny he was waiting for the bus to go to school and they came along and took off his yammukah and laughed and thought it was funny and they ran off went to school. the point was that they cant get away with this we are entering the summer it taught them a lesson. and the rest of class when they went to arrest them.

teach him what? self defense, so next time he knocks out those animals?

June 4, 2018 11:11 pm

if they attacked your son , you would be yelling and screaming. this 12 yrs old soon will be mugging and killing. throw the book now at them and hopefully they might have a shot in life. and by the way the larceny is getting off instead of a hate crime

I’m assuming you have not lived in this neighbor hood long or at all. They know we are ‘not that bad’, we don’t have to show them. In fact it’s precisely because they know that we don’t assault and intimidate and do violence that they feel brave enough to continually harass this community. A sad fact but it’s just the nature of the beast. I’m sure you mean well- but we have nothing to prove to anyone.

Just my suggestion.
June 4, 2018 10:12 pm

They should have been charged with a hate crime, and as a punishment made to do some kind of cimmunL functions with a Jewish organization perhaps, so they can get to relate and acknowledge that we are not that bad after all. But, the argument that they are just twelve years old, my son was held up at gun point by a twelve year old kid.

I used to teach
June 4, 2018 8:27 pm

In that school, MS 61. Many of the kids are wonderful and some are clearly headed in the wrong direction.

Yidden are a tough bunch, we’ve made it through quite a lot more than this. Hope the kid is alright and his parents used it as an opportunity to teach him well. Hope the little black kids get on track.

Alternative consequence
June 4, 2018 8:19 pm

Instead of giving them a record with punishment, why not have them read three age appropriate books about Jews and Jewish history, and write reports on them. Much more likely to bring about change. At 12 y.o., theses are children acting from ignorance and prejudice.

Did them a favor
June 4, 2018 7:53 pm

They are probably bullies and pull these shenanigans all the time on their classmates. They went too far and thought they can play their games on random people in the street and now they will learn the hard way.

As I see it, we did their entire school a big favor. These kids will get disciplined and think twice before bullying people.

June 4, 2018 6:51 pm

For those who were confused or wondering, the boys were charged with grand larceny because they stole a religious article. It didn’t qualify as a hate crime because they only laughed and didn’t say anything hateful. The purpose of arresting them is to deter more such behavior from them or their peers. Instead of being the cool kids who got away with the yarmulka they are now in trouble. They won’t get serious punishment. It’s meant to shake them up. My sympathies are with the young children who live in fear and not with the culprits. If we let them… Read more »

There has to be deterrents so this can never happen again.
If you disagree that’s your business.

I believe children should not even dream of doing such crimes against people from other communities (Jewish kids would never). The only way for that to happen is if there are deterrents.
If you disagree that’s your business.

They will not be prosecuted
June 4, 2018 6:37 pm

They’ll be sent right back to their parents.
They don’t care about these kinds of crimes against Jews.

The District Attorney will not charge these punks
June 4, 2018 6:37 pm

Because he doesn’t care about “petty” crimes against us.
If everyone in Crown Heights voted he would care.

The children will be let free
June 4, 2018 6:17 pm

I wonder why…

Nothing will happen to them. The DA will make sure of that.
June 4, 2018 6:14 pm

Do you vote? No? So thank you for this.

community service
June 4, 2018 6:01 pm

these kids just need community service. prejudice comes from not knowing who you hate only rumors.

June 4, 2018 5:35 pm

You all write about things you don’t know. According to the NY Penal Code Article 155.30:

Grand Larceny in the 4th Degree

A person is guilty of grand larceny in the fourth degree when he steals property and when:

5. The property, regardless of its nature and value, is taken from the
person of another

If something is stolen directly from or off a person it qualifies as grand larceny regardless of the value of the object.

We need more parents or babysitters in the mornings and afternoons
June 4, 2018 5:33 pm

I see many young children walking to and from school by themselves. Unfortunately with this situation and others, I really think we need to have younger children walking in groups and/or with escorts at all times. 8 is very young to be out alone.

1. Why grand larceny was the charge for a yarmulke that was presumably not expensive
2. I didn’t say they didn’t deserve punishment. But I don’t think twelve year olds deserve a criminal record with a heavy charge. If you believe children should be punished so harshly, that’s your business.

Antisemitic hate diet
June 4, 2018 5:23 pm

That’s what their children are constantly fed.
Any wonder this is the result?

Result of black antisemitic hate that's constantly preached
June 4, 2018 5:19 pm

If everyone in Crown Heights voted we’d be able to pressure the politicians to pressure black “leaders” to put an end to it.
No one in Crown Heights votes, so look in the mirror and blame yourself everyone.

Snarky commentors: keep your dribble to yourself!
June 4, 2018 5:18 pm

Just thank Hashem it wasn’t your child that was victimized.
I hope no one else becomes a victim to any kind of crime.

Fact check
June 4, 2018 5:18 pm

Who is fact-checking these articles? Grand larceny constitutes property exceeding $1,000 in value. Do you actually believe an eight year old was walking around wearing a $1,000 yarmulka? Not to mention the fact that, if true, entering the two older boys into the penal system for a mean-spirited but legally insubstantial offense only breeds anger, distrust, financial hardship, and potentially actual crime down the road. How many of you didn’t play a prank or even take something that wasn’t yours as a child? Were you arrested and charged with a crime for it? Have some sense.

To #5 "Confused"
June 4, 2018 5:09 pm

What are you “confused” about exactly? Antisemitic criminals need to be punished for victimizing and/or traumatizing someone.
Something about that you disagree with?

June 4, 2018 5:07 pm

get them scared to do crime at a young age maybe they will control themselves in the future

To #1 "Levy"
June 4, 2018 5:06 pm

Your snarky sarcasm is very selfish. I hope you’re not the victim of such a hate crime one day whereupon your lowlife attitude will change very quickly.

Comment #1 and #5 have no problem with hate crimes. How sad.
June 4, 2018 5:05 pm

It’s not the item’s money value that’s the issue here. A antisemitic hate crime was committed and a victim has been traumatized. If our neighbors” care about good relations they’d stop preaching antisemitic hate to their kids all the time.

June 4, 2018 4:25 pm

Is this article accurate? What they did was cruel at worst, stupid at best. Do they really deserve a criminal record over this though? I don’t see how throwing the book at two 12 year olds will do anything for our community’s relationship with our neighbors. Plus grand larceny as the charge doesn’t even make sense. This seems more like petty theft or hate crime to me…

Grand larceny?
June 4, 2018 3:49 pm

Why aren’t they charged with a hate crime.

Grand larceny?
June 4, 2018 3:49 pm

Is that correct?

No kidding
June 4, 2018 3:48 pm

Their mom (another ABW) must be seething! First they get denied for an apartment (“because you Jews won’t even rent to us”) now her poor child gets in trouble for snatching a yarmulke? Keeping the black man down in America…

June 4, 2018 3:45 pm

Grand larceny? That must have been a very expensive yarmulke!
