It appears that the Rabbi needs to clarify the difference between the Esrog and the Matzos, in that by the Esrog- the defendant totally lost it and therefore had to give the whole value. Whereas by the Matzos, the broken ones are still in play. Let’s say broken ones cost $20 a pound. Can the defendant say he only caused a $10 loss and pay 10 to make up the difference between whole and broken? Or can the owner say he has to pay him 30 to get new ones? And who would keep the broken ones in that case?
