On Monday, November 3, 2014, Nathan and Alyza Lewin once again argued “Zivotofsky vs. Kerry” before the Supreme Court.
The case concerns Menachem Zivotofsky, who was born to American parents in Jerusalem 12 years ago. When the dual citizens applied for their son’s American passport, the Embassy refused to list his place of birth as Israel. Since Israel’s founding in 1948 the position of the United States has been that no country has sovereignty over Jerusalem until its status is negotiated successfully in a peace deal.
The Zivotofsky’s suit to uphold a law passed in congress that allowed Israel to be listed as the country of birth eventually made its to the Supreme Court in November of 2011. Rather than issuing a definitive ruling, the Supreme Court sent the case back to a lower court for further action. But three years later, Zivotofsky vs. Kerry is back in the Supreme Court.
In this fascinating talk at the National Jewish Retreat, hear Alyza Lewin discuss firsthand the lengthy legal journey that this case has traveled.
If a vaYoel can be submitted for reconsideration [like an igros Moshe, according to Reb Moshe], his two sources are Rambam (igeres Teimon) and primarily the Maharal (Netzach Yisroel). Reconsideration is recommended following the rediscovery of the Maharal’s pirush on Kesubos where it is implied that it will only be possible when Hashem wills it, and therefore it is not a prohibition (Rambam making no mention of it in Mishneh Torah).
There r 3 oaths that it says in the Gemara Kesubos & 1 of them is that we r not allowed 2 have a government in the Holy Land b4 Melech HaMoshiach comes so really Isreal isn’t supposed 2 b a state & we r not allowed 2 rule our one gov but bec its a sakana 2 give it back thats y we keep it. But it is Asur to have 1 there is a whole sefer called Vyoel Moshe it discusses this whole issue.
How can ‘The U.S. Supreme Court agree that ‘marriage’ is also a recognized institution, between a man & man or two women? Is this a proper legal definition? Let’s start calling a ‘lease’ a ‘mortage’ and vice-versa…why not change traditional definitions ad infinitum? If there’s money and power involved in America…anything goes.
Were I born in ‘Yerushalayim’ I would be happy not to have the word: ‘Israel’ appear on my passport. What educated & understanding Jew would want to recognize a state that operates against the principles of ‘Yerushalayim?’
The World hates Israel & Jews so it doesn’t matter what is said or written. Nothing changes (except it gets worse for us.) MOSHIACH NOW is all that will stop the insanity, there’s no point in trying to appeal to “humanity” because there isn’t any. The world has become de-humanized – you think it ended in 1945? That was just the beginning.
