A judge of the Supreme Court of the State of New York has given way for the controversial Crown Heights Vaad Hakohol election slated for Sunday.
Daniel D. Angiolillo, Associate Justice of the Appellate Division, Second Judicial Department, refused to discuss who is representing the Brooklyn neighborhood Jewish community.
The sides argued their case Thursday whether to hold elections, each claiming the be the real Representative of the community and being backed the the rabbis (Avraham Osdoba vs. Yaacov Schwei).
Edward Rudofsky, an attorney who represented Congregation Lubavitch Inc. in the 770 case, argued on behalf of the elections seekers (also known as the Schwei camp).
Justice Angiolillo ruled he is not prohibiting anyone from running, but said the case and merits are there.
While the elections will be conducted Sunday, May 24, the court hearing for June 3 remains with the possibility of disqualifying the election results.
Elie Poltorak, an attorney and candidate himself, told COLlive: “This means we can take office and the community’s voice will be heard. I urge everyone to come out and vote.”
“There is no validity to the election until the pending law suit is settled,” David Berger, an attorney to the ‘Osdoba camp,’ said.

to anyone who comments on this matter using the word community, please clarify which community do you refer to? if you mean geographical blocks, streets and houses don’t vote. if you mean people – what shared aspect do all crown heights residents have other than they live here? we don’t share rabonim, theological perspectives, or social laws. what’s the point of this “election” exercise. it won’t bind anyone or anything.

I am sure that Rabbi Osdoba also agrees that we need elections every few years. However there are priorities & Rabbi Osdoba wants unity before elections. Rabbi Shwei did not recognize the last legitimate elections for rabbanim as a result he does not hold of the concept of having a majority in the Bais Din that we can follow. What Rabbi Osdoba wants is for Rabbi Shwei to recognize previous elections before new elections happen, I feel that is unlikely for Rabbi Shwei to agree to recognize his opponents. My personal opinion is that it is the duty of every concerned and caring resident of crown heights to make sure to vote, or liberty will be their history. This is our opportunity to effect change and eliminate dictatorship communism, nepitisom, oligorchism from continuing to run our community down.
