Supporters of Sholom Rubashkin are gearing up for a new campaign to assist in Reb Sholom’s continuous fight for justice.
According to sources familiar with last year’s campaign, over $100,000 was raised last Lag Baomer.
The funds raised were put into good use, including the hiring a new prestigious lawyer to lead the current habeas corpus appeal, Stephen Locher of Belin McCormick. A Harvard Law graduate and former federal prosecutor, Mr. Locher is well known and respected in Iowa for his remarkable success in post conviction appeals.
Recently, the Rubashkin Team made several significant filings and have discovered further troubling conduct by both the Judge and the prosecutors.
Two weeks ago, Mr. Locher received a partial response from the FBI to a Freedom of Information Act (FOIA) request that he made a few months ago.
That response revealed that, during the several months leading up to the sentencing, there was significant activity by the prosecutors, the FBI and Judge Reade concerning certain emails that the Judge received that she believed came from supporters of Sholom and that she claimed contained “death threats.” The FBI concluded that there were no death threats but the Judge persisted in her assertions – which she made on an ex parte basis to the office of the prosecutors in Sholom’s case. As was seen in this case in the past, this was not disclosed to Sholom or his counsel – and, the prosecutors continue to refuse to provide the ex parte communications they had with Judge Reade, despite repeated requests.
The current appeal, known as a 2255, includes three grounds for appeal. The government has thus far responded to all three grounds, but they asked of Judge Reade that only one of the grounds be dismissed, Ground 3. This ground reveals newly-discovered evidence that clears Sholom of money laundering.
Judge Reade ruled that the defense should only respond to the government’s motion to dismiss Ground 3 and should hold off on responding to the other two grounds.
Mr. Locher recently filed this reply motion and the Team is now awaiting the Judge’s decision. They are also waiting for her decision whether to recuse herself off the case or not. The Team still needs to work on several motions, including a response to the other two grounds, a motion requesting discovery, a motion to request a hearing, FOIA requests and possibly other motions.
Of course, all the above costs tens of thousands of dollars. Hence the reason behind this renewed campaign for Sholom’s legal defense. One and all are encouraged to participate with whatever they can afford to help Sholom reunite with his family.
Volunteers will be going around by the Great Parade and Fair the entire day of Lag Baomer to collect the much needed funds. They will be easily identified as they will be wearing special “Remember Sholom” t-shirts.
