What the gov did was harass all buyers and warn them – among other things, but primarily – that if they will allow any Rubashkin to stay in management of the business they will be hounded and hunted! This reduced the value of the business. No gvir would pay 40M for a business that was doomed for failure, as it wouldn’t have proper management. Only when someone came along and “scooped” it up for a few million did the gov ease off; because now they had their “case” against SMR. I want people to have clarity on this matter. There have been many reports that have excited people about his release, and I want to explain why he still very much needs Rachmei Shamayim. I have a lot of respect for Mr. Dershowitz, but in the spirit of transparency, he is, after all a defense lawyer, and it is his job to think in terms of defense. There is a simple answer to your question:

1. Nobody knew the true value of the company at the time. It’s an enormous task to figure out what the value of the company is. Many times, after consolidating all the debt, the company could potentially be worth nothing at all. Why would a “gvir” throw 20,30,40 million at a company that could be worth far less?

2. Nobody suspected that judge Reade would actually give such a harsh sentence. It’s unimaginable. It’s likely that HAD people known, they would have made a higher offer for the company. Hindsight is 20/20.

Just trying to put the pieces together here. Maybe someone can help me. Based on the article intro it seems that if the business would have been bought for a price that did not create a loss for the bank, the sentencing would have been max 3 years or so. The entire Jewish world was up in arms about thihs story and people were willing to give large amounts of money. Why couldnt several gvirim, together with a fundrasing campaign, buy the business for its real value and avoid this entire disaster? i know hindsight is 20/20 but is this… Read more »

The honorable (sic) Judge Reade heard testimony from all those that testified under oath during the trial declaring the same issues that are being presented now. She chose then to ignore thier testimony, and allegedly “believed” the testimony of Paula Roby. Her blatant, nefarious duplicity in manipulating an outrageous sentence was due to her bias, and inherent vileness, and unless she chooses the just course of recusing herself we have to pray and rely on Hashem’s rachmonus , and not the judicial system to rectify this gross travesty of justice.

Judge Linda Reade has declared herself innocent and refuses to recuse herself from this case. She is hoping this case will go away and everyone will forget about Rubashkin. Hardly!
She eventually will have a lawsuit against her, and perhaps will even have to sit in prison herself. The tables will be turned.

So now ‘Judge’ Reade has possibly found a way to reverse the sentence without taking ANY responsibility herself – she’s found Paula Roby’s testimony to blame. That’s why there is hope. Disgusting. The system is rotten to the core when a judge can do as she did and still judge cases. Where’s Reade’s honesty or integrity? Non-existent.
