Former Postville meat plant executive Sholom Mordechai Rubashkin should remain in custody before his sentencing on 86 financial fraud charges, a panel of federal appeals court judges ruled Friday.
The 3 judge panel from the 8th U.S. Circuit Court of Appeals in St. Louis upheld a judge’s decision to hold Rubashkin without bail, before he is sentenced.
Rubashkin, 50, was convicted in November of charges that included mail, bank and wire fraud, making false statements to a bank, and failing to pay cattle providers in the time required by law.
Prosecutors have said the former vice president at Agriprocessors Inc. faces a recommended prison sentence of 21 to 27 years.
A sentencing date for Rubashkin is not yet set.
In other news, Rubashkin and his father, Agriprocessors founder Abraham Aaron Rubashkin, are facing 9,201 counts of misdemeanor child labor law violations.
Judge Nathan Callahan said he would set aside three weeks for the trial set for May 4, 2010.
Also charged are the company – a kosher meatpacking plant in Postville – and human resources workers Elizabeth Billmeyer, Laura Althouse and Karina Freund.
The trial is scheduled to be held in Waterloo, though it would be moved if an impartial jury can’t be found.

How can 21 to 27 years be considered justice when cold blooded killers and murderes receive a lesser sentence.

There, with tears in my eyes, I recited ‘The Pledge of Allegiance.’
After carefully and sincerely studying the Rubashkin trial I will again say the pledge: ” I pledge allegiance to the flag of The United States of America, one nation, under G-d, with liberty and justice FOR SOME.”
